These terms and conditions apply to all the work which us undertaken by the digital marketing agency The Digital Push when works are booked through its website. This site is owned and operated by SIRI IMPRESSIONS LIMITED with a registered address in KENYA.
Contracts
As soon as the customer has accepted the quote of an offer for digital marketing services from www.thedigitalpush.co then a contract is formed between them. When a quote has been issued then customers have a period of 14 days to be able to respond to the quotes, and after this period of time then the quotes shall no longer be valid.
The digital marketing services shall begin from the date which the quote has been agreed from, and then they shall last for the duration of time specified in the contract unless this is otherwise modified by any of the parties.
All customers will need to register for an account on the website www.thedigitalpush.co before they are able to use these products and service.
The Digital Push’s obligations
The agency shall use all reasonable endeavours to provide the services that it offers and to deliver the best possible results for all its clients.
It will also use all reasonable endeavours to make sure it meets any and all of the performance dates which have been outlined in the quotation. As an example, a deadline may be set for the completion of a website development project. However, please be advised that such dates shall be estimates only.
Customer obligations
During the course of its business with www.thedigitalpush.co the customer shall co-operate with www.thedigitalpush.co in all matters relating to the provision of its products and services. When asked, it shall provide the agency with all the materials which they have requested in order for the agency to complete its work and the customer shall provide these in a timely manner.
It is the customer’s responsibility to ensure that all the materials which they provide are owned by them and that they have the permission as the legal owner of these products to use these materials in the provision of these services.
In any event that there has been a delay to the delivery of services where this has been caused by the client, then the agency as well as its agents, subcontractors, consultants or employees shall not be liable for any costs, charges or further losses which have been sustained or incurred by the client which arise directly or indirectly from such delays.
The customer shall also indemnify the agency against all losses, costs or charges which it may incur as the result of any action, claim or threatened claim which the agency’s use of the materials in accordance constitutes an infringement of the intellectual property rights of any third party.
Payments and charges
Customers are required to pay all the charges which have been specified as part of the quotation, and these charges shall all be due in full and in advance of any of the digital marketing services being carried out. All invoices shall therefore be payable upon receipt, and all payments must be made online using bank transfers where both Visa and Mastercard are the accepted forms of payment. When the customer has not made the payment in a timely manner then www.thedigitalpush.co has the right to refuse the provision of services.
Any additional work which is then requested by the customer after the invoice has been issued shall come at an additional cost to the customer and will need to therefore be invoiced separately.
All parties must agree any be aware that www.thedigitalpush.co may review and increase its charges at any time.
All successful payments will show the billing descriptor SIDP, KENYA on their credit card statement.
Delivery
The agency shall deliver the digital marketing services to the timeline and deadline which has been specified by the client and has been agreed by both parties in writing. The agency shall use all reasonable endeavours to improve the visibility of the customer’s brand or business online, but the business shall have no liability for any changes in the position of a customer’s website in search engine results.
We understand the value of time and offer our customers the flexibility to select their preferred service duration. While we recommend certain durations for best results, the decision is yours to make. Service durations range from 1 to 12 months, giving you the freedom to customise your purchase according to your requirements.
If you decide to extend your package duration, you can easily do so by making another purchase on our website or contacting our dedicated support team. Your satisfaction is our top priority, and we're here to assist with any questions or concerns you may have about your package duration.
Refunds
To request a refund, customers need to contact us using the information at the bottom of these Terms and Conditions. If approved, refunds will be processed within 10 business days using the original payment method.

Intellectual property rights
Unless it has been otherwise stated in writing, all Intellectual Property Rights and the other rights and deliverables in relation to any of the digital marketing sites offered shall be owned by www.thedigitalpush.co which also includes its website and RL.
Limitation of Liability
The agency www.thedigitalpush.co shall not be liable for any loss of business, loss of goods, loss of contract, or loss of use during the use of its service which could include but not be limited to – the customer’s website being down, or the loss of any data, or any other special, indirect, consequential, or pure economic loss, costs, damages, charges or expenses.
Termination and cancellations
Either party may terminate this contract at any time. Customers may only cancel their orders for services in advance of the services being carried out. After this time they shall be liable for the full cost of services, regardless of whether they decide to complete them or not.
